You should care about Colorado House Bill 08-1103. There are simply too many unsafe and irresponsible inflatable rental companies in Colorado, and the Legislature decided it is time to do something about it to improve public safety. On January 31, 2008, the bill passed the House Business Affairs Committee with unanimous approval.

If you’re shopping for an inflatable rental, a good question to ask is “How do you plan to comply with House Bill 08-1103?” Be cautious with weak answers, or responses like “What is House Bill 08-1103?” Once these new rules take effect, a company that doesn’t comply with the law could go out of business. The sad reality is that the more unsafe and irresponsible an inflatable operator becomes, the more competitive they can be on price, and everyone wants the most value for their dollar. For example, if an inflatable operator decided to operate without insurance, business licensing, and proper anchoring, they can save a significant amount of money. This savings can then be used to offer very low prices, which are attractive to many consumers. These are often things that the consumer would never know that they were doing without.

Unfortunately, this savings comes at a significant risk to the public. Operating without proper anchoring will virtually guarantee that a serious injury will occasionally occur with surprise weather conditions. Because the operator doesn’t have insurance, there is no protection for the consumer in the event of a serious accident. In addition, businesses that are not properly licensed are also not likely to be paying the taxes that support your child’s school. All of these unacceptable compromises occur below the radar of the consumer. You are essentially tricked into thinking you’re getting a good deal, when the operator is actually putting you at risk, and silently working to weaken the public infrastructure that we value so dearly.

In the near future, House Bill 08-1103 will become law, and as a smart consumer, you need to be sure that the company you have chosen is ready for the change. The new rules will set some basic, common sense standards for the industry that will improve public safety and penalize some of the shady business practices that are occurring today. In fact, the penalty for not complying with the law can be as high as $1,000 per day, which is enough to run the most egregious offenders right out of business. Make sure you’re not relying on an operator that isn’t informed, for the sake of your party, and for the safety of the public.
